General Terms and Conditions
General information:
The General Terms and Conditions apply to all our contracts and services in the currently valid version. These General Terms and Conditions shall be deemed to have been accepted at the latest when products from our range are ordered.
Contract:
No minimum order quantity. All offers in this store are subject to change. Orders are accepted via our online store. The order will be confirmed in writing by email.
Prices:
All prices include the statutory value added tax.
Terms of payment:
We deliver unlimited against payment PostFinance, Visa & Mastercard, TWINT, Paypal, prepayment, and POWERPAY (purchase on account up to 500.- CHF) With the order the customer commits himself to payment and acceptance. Any costs arising from non-compliance are to be borne by the customer.
Purchase on account with installment facility (POWERPAY)
As an external payment service provider, MF Group / POWERPAY offers the payment method "purchase on account". With the single invoice, you can simply pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept POWERPAY's GTC in addition to our GTC. (powerpay.ch/en/agb).
Delivery:
Information on delivery dates and delivery periods is non-binding. Under no circumstances do delays in delivery justify claims for damages or a right to withdraw from the contract. In accordance with the Swiss Code of Obligations, the goods are a debt to be collected. The buyer therefore bears the risk of any loss of goods upon delivery or after delivery by the shipping service provider. This also applies in the case of partial deliveries. The customer is obliged to check the delivered products for completeness and correctness immediately after delivery and to notify XXL-Parfum in writing of any damage, defects and complaints immediately after discovery, at the latest 7 days after delivery. Returns & exchanges
Returns will only be accepted if the product arrives at our central warehouse unopened and in its original condition. Products marked with the product type: without packaging, tester & no lid are excluded from return! You have the right to cancel this contract within fourteen days without giving any reason. The revocation period ends fourteen days after the day on which you or a third party named by you, who is not the carrier, have physically taken possession of the last goods. The return shipment must be made within 14 days of receipt of the goods after the withdrawal period. The return costs shall be borne 100% by the buyer.
Goods that are returned despite a clear definition of the conditions for a return & exchange will not be refunded.
Original condition means: The packaging, i.e. the plastic film or the quality seal, has not been opened or removed! Products marked without packaging, tester & no lid are generally excluded from exchange and will therefore not be taken back or refunded under any circumstances.
It is important to us to provide clarity: As a retailer, we have no control over the composition or ingredients of the perfumes. Manufacturers are constantly tweaking and changing their formulas, often in response to legislation or for other company-specific reasons. While we understand that this can be frustrating for consumers at times, manufacturers are not required to publicize changes in ingredients, so we as retailers are not informed either.
Understandably, it may be disappointing if a perfume does not match the expected fragrance notes or is perceived differently than before. However, we would like to emphasize that once products have been opened - i.e. once the plastic film or the seal of approval has been removed - they cannot be returned. This also applies if customers have the subjective impression that the product has a different fragrance. As a retailer, we have no control over the production processes and can therefore accept no responsibility for such changes. We would like to emphasize once again that we only sell 100% original products.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail) sent by post to XXL Parfum GmbH, Solothurnstrasse 31, 3303 Jegenstorf, Switzerland. by telephone on +41 31 512 99 86 or by e-mail to info@xxl-parfum.ch. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. Returns must also be sent to the above address.
Voucher/discount code
Only one voucher or discount code can be redeemed per order. It is not possible to combine several vouchers or discount codes - regardless of whether they are gift vouchers or discount codes. By completing the order, the customer agrees to this regulation and acknowledges it.
Bonus program
Customers with a registered customer account automatically participate in the bonus program. One bonus point is credited for every franc of the order value. 20 bonus points correspond to 1 CHF bonus credit (5% cashback). The bonus points will only be credited once the order has been fully completed (payment received and parcel dispatched). In the case of returns or partial returns, the corresponding points will be deducted from the account. Bonus points are valid for 24 months from the time they are credited and then expire automatically. Cash payment of bonus points is not possible. The bonus credit can be converted into a CHF voucher at any time in the customer account, which is valid for the entire product range. Bonus points can also be redeemed directly for selected products during special promotions. XXL-Parfum reserves the right to adjust or discontinue the bonus program at any time.
Retention of title:
The goods remain the property of XXL-Parfum until full payment has been received.
Warranty:
The warranty period is 24 months from receipt of the goods. Further claims by the buyer are excluded, regardless of the legal grounds. The customer shall bear the costs of return shipments.
Place of jurisdiction:
All obligations are subject to Swiss law. The place of performance and exclusive place of jurisdiction is BL Liestal.
Final provisions:
Verbal agreements are only binding if they are confirmed in writing by XXL-Parfum. Should individual provisions of these GTC be or become invalid, this shall not affect the legal validity of the remaining provisions.
